Welcome to BeautySpark. These Terms and Conditions ("Terms") govern your use of our AI-powered beauty assistant application and services. By accessing or using BeautySpark, you agree to be bound by these Terms.

3. Subscription and Billing

3.1 Subscription Plans

• •BeautySpark offers multiple subscription tiers with monthly credit allocations
• •Credits are allocated at the start of each billing period and expire at period end
• •Unused subscription credits do NOT roll over to the next billing period
• •All subscriptions automatically renew unless cancelled before the renewal date

3.2 Credit Purchases

• •Additional credits may be purchased separately
• •Purchased credits expire 1 year from purchase date
• •Credits are non-refundable once used for generation services
• •Credits are deducted in order: subscription credits first, then purchased credits (oldest first)

3.3 Payment Processing

• •Payments are processed through RevenueCat, our third-party payment processor
• •By subscribing, you agree to RevenueCat's terms and privacy policy
• •BeautySpark does not store your payment card information

4. Refund Policy

• •Credits used for successful generations are NON-REFUNDABLE
• •We may refund credits for failed generations at our sole discretion
• •Refund requests must be made within 7 days of the charge
• •We reserve the right to deny refunds for suspected abuse or fraud

5. Chargebacks and Payment Disputes

Before initiating a chargeback, you MUST contact our support team.

Unauthorized chargebacks will result in:

2. 2.Forfeiture of all credits and subscription benefits
3. 3.Potential legal action to recover costs
4. 4.Permanent ban from using BeautySpark services

We may pursue recovery of chargeback fees, legal costs, and damages. Repeated chargebacks may be reported to fraud prevention services.

6. Consumer Rights (UK Consumers)

14-Day Cooling-Off Period

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, UK consumers have a 14-day cooling-off period from the date of subscription purchase.

By clicking "Generate Makeup" or using credits, you acknowledge that services have been fully performed at your request and you forfeit your right to cancel and receive a refund for consumed services.

7. User Content and Photo Uploads

7.1 Your Content

When you upload photos or other content to BeautySpark, you retain ownership of your content. However, by uploading content, you grant us a limited license to:

• •Store your content temporarily for service provision
• •Use your content to improve our AI models (in anonymized form)
• •Display results and recommendations based on your content

7.2 Content Guidelines

You agree not to upload content that:

• •Infringes on intellectual property rights
• •Contains harmful, offensive, or inappropriate material
• •Includes images of minors without proper consent
• •Contains malware or viruses
• •Promotes illegal activities

8. Acceptable Use Policy

You agree to use BeautySpark only for lawful purposes. The following uses are strictly prohibited:

• •Using the service for any form of abuse, violence, or harm to others
• •Creating or distributing pornographic, sexually explicit, or obscene content
• •Harassing, bullying, or intimidating other users
• •Promoting hate speech, discrimination, or violence
• •Impersonating others or providing false information
• •Attempting to reverse engineer, hack, or compromise the service

9. AI-Generated Content

BeautySpark uses artificial intelligence to generate beauty recommendations and makeup suggestions. Regarding AI-generated content:

• •AI recommendations are suggestions only and not professional beauty advice
• •We do not guarantee the accuracy or effectiveness of AI-generated suggestions
• •You use AI-generated content at your own discretion and risk
• •BeautySpark is not liable for any adverse reactions or results from following AI suggestions
• •AI-generated content remains our intellectual property

10. Disclaimers and Limitations

10.1 Service Disclaimers

BeautySpark is provided "as is" without warranties of any kind. We do not guarantee that our services will be uninterrupted, error-free, or meet your specific requirements.

10.2 Beauty and Health Disclaimer

We are not responsible for any allergic reactions, skin irritations, or other adverse effects resulting from following our AI suggestions.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the courts of England and Wales.

12. Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for conduct that we determine to be harmful to our service or other users.

You may also terminate your account at any time through your account settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through our application. Continued use of BeautySpark after such modifications constitutes acceptance of the updated Terms.
